For the reason mentioned in the application, the same stands allowed and documents are taken on record subject to all just exceptions. CR No.2717 of 2016 This petition has been filed against the concurrent orders dated 01.08.2012 and 11.01.2016 passed by the learned Courts below evicting the petitioner from the demised premises.
CR No.2717 of 2016 (O&M) Anuradha 2016.05.13 14:03 I attest to the accuracy and authenticity of this document After arguing for some time, learned counsel for the petitioner, on instructions, states that the petitioner will not press this petition on merits and will vacate the premises voluntarily on or before 31.05.2017 without forcing the respondent to file an execution petition and will continue to pay the monthly contractual rent in advance by the 7th of every month, and pay the other admissible charges regularly. He further undertakes to pay up to date of arrears of rent, if any, within a period of one month from today. Learned counsel for the respondent No.1, on instructions, has also accepted this offer on the condition that the petitioner will file an undertaking to the above effect before the Executing Court within one month, with the condition that in the event of any default, this petition should be deemed to be dismissed.
