**** ANUPINDER SINGH GREWAL, J (ORAL) The petitioner has sought modification of the award of the Railway Claims Tribunal dated 12.11.2018 to the extent that instead of direction that the compensation amount along with interest thereon be invested in FDRs, it be released to the petitioners. The petitioners are the widow, sons and daughter of the deceased. They all are over 18 years of age and, therefore, they are competent to utilize the money in their own interest.

Learned counsel for the respondent-Union of India states that in terms of the award of the Railway Claims Tribunal, the compensation amount has been invested in the FDRs in favour of the petitioners. He further states that he has no objection in case the compensation amount is directed to be disbursed to the petitioners.

Consequently, the petition is allowed and the award of the Railway Claims Tribunal is modified to the extent that the amount of compensation along with interest thereon which is invested in the FDRs shall be released by the Bank to the petitioners within a period of 15 days from now.
