There is no scope for modification or amendment sought which has been granted on the preliminary evidence which is produced before the Court below. The Court below has granted ` 4,000/- as maintenance for the wife and minor child who is 9 years of age. According to the counsel, the respondent is a property dealer who owns a house and a car. With no specific details of the income status of such a property dealer if the Court has awarded ` 4,000/-, I will find no cause for modification.

The petitioner is at liberty to furnish appropriate proof before the Court below and seek for modification of the order for enhancement. If such plea is made, the Court will consider it afresh and till such redetermination is made, the amount of ` 4,000/- will be required to be paid by the husband.
