*** Counsel for the parties have not put in appearance. Sher Singh S/o Narota Singh filed a suit for permanent injunction seeking a stay order against Gurdev Singh restraining him from raising any construction over any specific portion/Khasra number in front over the joint land as detailed in plaint.
Additional Civil Judge (Senior Division), Rajpura in its interim order, directed the respondents to restrain from raising any construction during the pendency of the suit. This order was challenged in an appeal filed by Gurdev Singh in the lower Court and the same was dismissed. Feeling aggrieved, the present petition came into being. With a view to find out the fate of the suit pending before the court below, information was sought from the District Judge, Patiala who has conveyed that Gurdev Singh has expired and accordingly, the proceedings of the case stand abated. File of the suit has been ordered to be consigned to the record room.
This being the position, this revision petition has become infructuous and is, accordingly, dismissed.
Copy of this order be sent to the counsel for the parties at their residential addresses for their information. (G.C. GARG) PRESIDENT (N.K. KAPOOR) MEMBER January 09, 2015 naina
