During the pendency of the suit, the trial Court has nominated the Local Commissioner to demarcate the land vide order dated 11.12.2019. This revision petition has been filed by the defendant No.1 and 2 challenging the correctness of the aforesaid order 2.

The learned counsel representing the petitioners submits that second application for the appointment of Local Commissioner in the absence of setting aside the previous report, was not maintainable. It has been alleged by the plaintiff that the previous report was managed by the defendant No.1 and 2 in collusion with the Local Commissioner. Hence, the Court, in the facts of the case, considered it appropriate to nominate another Local Commissioner. After the report is submitted by the Local Commissioner, the trial Court will evaluate those reports while deciding the DEEPAK KUMAR BHARDWAJ 2022.11.24 10:25 I attest to the accuracy and integrity of this document

Keeping in view the aforesaid facts, no ground is made out to interfere with the impugned order. Hence, the present revision petition is dismissed.
