CORAM:

HON'BLE MR. JUSTICE INDERJIT SINGH

Present:

Mr.Rahul Bhargava, Advocate for the petitioner.

**** INDERJIT SINGH, J.

Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.159 dated 10.09.2018 under Sections 379-B, 34, 411 and 120-B IPC, registered at Police Station Division No.1, Jalandhar.

I have heard learned counsel for the petitioner and have gone through the record.

The perusal of the FIR shows that when complainant Baldev Raj, after finishing the work at fruit stall was going on his Activa at 12.20 p.m. carrying `2,13,000/- wrapped in a cloth, to be deposited at shop No.30, he saw that three clean shaven boys were coming on motorcycle and the person who was sitting on the back, forcibly snatched the cloth containing the amount from complainant's hand and ran away on the motorcycle. The VINEET GULATI 2019.01.23 17:24 I attest to the accuracy and authenticity of this document Chandigarh complainant fell down along with Activa and received injuries.

CRM No.M-1809 of 2019 -2The present petitioner has been challaned by the police regarding the occurrence.

Keeping in view the facts and circumstances of the present case and in view of the nature and gravity of the offence and also in view of the fact that there is every chance of tampering with the evidence, I do not find it a fit case where petitioner is entitled to benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.
