(ORAL) Petitioner is seeking the concession of interim bail in FIR No.65 dated 05.05.2023 under Sections 22, 29 of the NDPS Act, registered at Police Station Doraha, District Khanna, for a period of three weeks from 17.01.2025 to 06.02.2025, for attending the marriage of his sister, which is due to be solemnized on 02.02.2025 at Doraha. 2.
In compliance of order dated 17.01.2025, status report by way of affidavit of Deputy Superintendent of Police, Sub-Division Payal, Police District Khanna, District Ludhiana, has been filed in the Court today, which is taken on record subject to just exceptions. Copy has been supplied to the counsel opposite in the Court today. 3.
Learned State counsel has not disputed the submissions made by the counsel for the petitioner on the previous date of hearing that the marriage of the petitioner's sister is indeed due to be solemnized on 02.02.2025 at Doraha. It has also not been disputed by the learned State counsel that the petitioner is the elder brother of the girl, whose PUNEET SACHDEVA 2025.01.24 15:24 I attest to the accuracy and integrity of this document Chandigarh

On a pointed query put to the learned State counsel as to whether the petitioner is involved in any other case under the NDPS Act, he, on instructions, has replied in the negative and has submitted that four prosecution witnesses in the present case have already been examined out of the total 17 cited. 5.
I have heard learned counsel for the parties and perused the relevant material on record.

In view of the submissions made in the affidavit, which has been placed on record today, this Court deems it fit to extend the concession of interim bail to the petitioner w.e.f. 26.01.2025 to 03.02.2025 to the satisfaction of the trial Court/Duty Magistrate concerned to attend the marriage of his sister subject to the condition that he shall not leave the jurisdiction of District Ludhiana during the aforementioned period. The petitioner shall surrender back in the jail where he is currently lodged on 03.02.2025 by 5:00 PM. 7.
In case the petitioner is found misusing the concession of interim bail, the State would be at liberty to approach this Court forthwith seeking cancellation of the same.

The petition stands disposed of accordingly.
