The plaintiff is aggrieved that the court fee has been directed to be paid. It is meaningless to argue that ad valorem court fee could not have been directed to be paid when there was a prayer for recovery of possession. The court will determine the value of the property at the time when the court fee is paid. The value will be determined on any registered sale deed in the vicinity of the property which is the subject matter of suit or by applying for test through the bailiff appointed by the Court for collecting information regarding the valuation.
