IN THE HIGH COURT FOR THE STATES OF PUNJAB AND HARYANA AT

CHANDIGARH C.R. No.2814 of 2016 Date of Decision.10.05.2016 Ajay Singh Gehlawat .......Petitioner Vs.

Municipal Council, Sonepat and another ........Respondents

Present:

Mr. Anil Rathee, Advocate for the petitioner.

CORAM:HON'BLE MR. JUSTICE K. KANNAN 1.

Whether Reporters of local papers may be allowed to see the judgment ?

2.

To be referred to the Reporters or not ?

3.

Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.

The decree that does not exist is set in execution. It is contradiction in term that a decree that was not drafted could be executed. It is a case where the suit was withdrawn on the basis of some statement by the respondents. The said statement could be a basis for a fresh suit and can not give room to effect of a decree. The counsel relies on judgment in Ranbir Singh Vs. Inderjit Kaur and others 2012 Vol. CLXVI PLR 459. I am afraid, I may not be able to allow for understanding of judgment which is against common sense. 2.

The order already passed is maintained and the revision petition is dismissed.
