(ORAL) Seeking transfer of the case from the concerned Court to some other Districts on the grounds that the complainant is a leading practicing counsel and is likely to influence outcome of the trial, the petitioner has come up before this Court. The nature of relief which the accused/petitioner seeks is based on presumptions and suspicion which cannot be a ground for legal interference.

However, in case during the trial the accused/petitioner notices any prejudice because of the complainant being a leading practicing advocate and also on behalf by any Presiding Officer, it shall be permissible for the petitioner to file an application before this Court for transfer of the case to some other District Court. Given above, the present petition is disposed of with the aforesaid observations. All pending applications, if any, stand disposed of.
