CHANDIGARH CWP-1108-2022 Date of decision: 03.02.2022 Lakshita Rohilla

...Respondents
CORAM: HON'BLE MR. JUSTICE ARUN MONGA
Present:
Mr. Ravi Verma, Advocate, for the petitioner.
Ms. Kirti Singh, DAG, Haryana.
(Presence marked through Video Conference) -.- ARUN MONGA, J. (ORAL) Petitioner herein, inter alia, seeks issuance of a writ in the nature of certiorari to quash the impugned order dated 06.07.2020 (Annexure P-5) qua her, vide which her appointment to the post of Medical Officer (HCMS-I) has been cancelled by respondent No.1. 2.
Petitioner submitted a representation dated 26.06.2020 but regardless, the respondent No.1 cancelled the appointment letter in respect of 188 candidates including the petitioner for not joining their duties within the stipulated period. Later, respondent No.2 gave final opportunity on 21.09.2020 to all the candidates to join their duties till 24.09.2020. However, for lack of awareness about the aforesaid fact, the petitioner was not able to join her duties as Medical Officer within the prescribed time i.e. 24.09.2020. Thereafter, petitioner submitted several representations followed by issuance of a legal notice. But to no avail. On the other hand, vide advertisement dated 08.01.2022 (Annexure P-10), respondents have now advertised the vacancies of Medical Officers. Hence, the instant petition. 3.
I have heard learned counsel for the petitioner and gone through the case file.

4.
No grounds are made out to interfere. Petition has been filed belatedly, as the cancellation letter dated 06.07.2020 (though later extended until 20.09.2020) has been now challenged very belated in the year 2022, that too when the posts have been advertised afresh. There is no room for interference by this Court. Dismissed on the ground of delay and laches alone.
5.
However, liberty is granted to the petitioner to pursue her pending representation/legal notice and the respondents may look into the same, in case, they would like to take have a lenient outlook in their own interest, since concededly, there is a serious shortage of medical officers in the state.
