There is no justification for the petitioner to arrive to this Court to complain that the Court has not given sufficient opportunity. If the petitioner was not able to summon the witnesses in spite of several opportunities, he must set forth the reasons why he could not do that and seek for reopening of the case and for further issue of summons. The procedure has been set forth by this Court in Santosh Kumar Berry Vs. Nirmala Devi and others 2013(1) PLR 404. The petitioner is advised to resort to such process as has been set forth in the said judgment.
