After arguing for some time, learned counsel for the petitioner took the plea that he is ready to make the payment of `40,000/- before the appellate Court, where the matter is pending in appeal. Petitioner is at liberty to tender the amount before the appellate Court, if the appellate Court permits so. Petitioner seeks liberty to withdraw the present petition, at this stage. Liberty so granted.
