(Oral) Prayer is for grant of anticipatory bail in case having FIR No.73 dated 17.3.2022 registered under Sections 148, 149, 323, 506 IPC and Sections 3(1)(r), 3(1)(s), 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act at Police Station Buria, District Yamuna Nagar.

Counsel for the petitioner submitted that as per the allegations recorded in the FIR, it was co-accused Anil Saini, who abused complainantGAURAV SOROT 2022.08.23 18:39 I attest to the accuracy and authenticity of this order/judgment

( 2 ) CRM-M-17101-2022 Sant Kumar in the name of his caste and exhorted that the complainant be taught lesson for not depositing his installment in time and it is only coaccused Anil Saini who is alleged to have taken out his revolver and put the same on the head of the complainant and also snatched his motorcycle. The counsel for the petitioner further submits that the petitioner has joined investigation with the police in the light of previous order dated 18.5.2022 passed by this Court.

State counsel on instructions from DSP Rajat Gulia has not refuted the contention that the petitioner has joined investigation. The State counsel further submitted that recovery of snatched motorcycle has already been effected and now the petitioner is not required by police for further investigation or for custodial interrogation. In light of the above as the recovery has already been effected in this case and the petitioner is not required for any further investigation, the present petition is hereby allowed without commenting on the merits of the case and order dated 18.5.2022 is hereby made absolute.
