Vide impugned order dated 4.4.2013, the trial Court has permitted the defendant-respondent No.4 to produce affidavit dated 19.3.2013 though a similar affidavit had been filed on 24.1.2013.

The short question which arises for determination in the present case is whether the second affidavit permitted to be taken on record as EX.DW.11/A contains all the material facts relevant for the just decision of the case and the witness is still ready for cross-examination. It will be open to the counsel for the petitioners to impeach the credibility of the witness in context to any additions/improvements in the affidavit.

CR-2840-2013 (O&M) No ground is made out for interference in the impugned order dated 14.4.2013.

The petition is dismissed.

The parties are directed to appear before the trial Court for further proceedings on the date already fixed. (M.M.S. BEDI) July 7, 2015.
