The defendant is aggreived that the Appellate Court has allowed for amendment of the plaint without even awarding heavy costs. Costs is invariably a matter of discretion and in a litigation between son and father, if the amendment is brought to conform to the description as found in the village records, it ought not to be taken as causing any serious prejudice. The plaintiff will succeed or fail by the case of family settlement which he has pleaded and it will not matter that a khasra number which was wrongly described originally is corrected at the appellate stage.

I will find no cause for interference with the order already passed. The revision petition is dismissed.
