There is no scope of filing a counter claim after the defence is delivered. Defence delivered in this case must be understood as the date, when in October, 2015 the defendant has adopted the written statement filed by other defendants. There is no scope for allowing for counter claim to be filed subsequently in the language employed under Order 8 Rule 6A CPC.

The order already passed is maintained and the revision petition is dismissed. The defendant shall be at liberty to file his own suit if he so chooses to do against the plaintiff in respect of the disputed property.
