Prayer in this petition filed under Articles 226/227 of the Constitution of India is for the protection of life and liberty of the petitioner and directing respondent no.2 to preserve the CCTV footage of Police Station, CIA Staff, Tarn Taran. 2.

Counsel for the petitioner, on the last date of hearing, had submitted that apprehension of threat to life no more survives, however, the petitioner's prayer qua preservation of CCTV footage still exists.

Since the CCTV footage in question pertains to the year 2019-2020, this Court asked the State's counsel to verify whether CCTV footage is still there in their digital footage recording system or not, who, on instructions from ASI Inderjit Singh, submits that the video footage has been over-written and is not in their storage, as there was no order for preservation of the same.

Given above, no further order is called for in the present petition and the same is disposed of with aforesaid observations. All pending applications, if any, shall stand disposed of.

Needless to say that the petitioner cannot be blamed for taking so long to take up his matter, which was filed on 15.1.2020. Thus, the petitioner shall be at liberty to take this point of prejudice caused to him at the time of the trial stage, if not already taken.
