The present petition has been filed seeking quashing of FIR No. 153 dated 17.08.2022 under Sections 323, 34, 354-A, 406 and 498-A of IPC, registered at Police Station Women West, Gurugram and all subsequent proceedings arising therefrom qua the petitioners. 2.

Mr. Nitish Banka, Advocate along with Mr. Saransh Sabherwal, Advocate has put in appearance on behalf of the petitioners and submits that during the interregnum, the matter has been amicably resolved before the Mediation and Conciliation Centre of this Court and has placed on record settlement deed arrived at between the parties.

Learned counsel for the petitioner has submitted that although he has power of Attorney from the petitioner but the same does not bear the No Objection Certificate from the earlier counsel. 4.

At this stage, Mr. Manish Soni, Advocate earlier appearing for the petitioners in the main case submits that the petitioners have moved a complaint against him before the Bar Council and therefore, the NOC was not given. He submits that the complaint is with regard to the consent given for referring the matter to the Mediation Centre and it is alleged by the petitioners that no such specific consent was given. However, it is a matter of record that the parties have arrived at a settlement before the Mediation and Conciliation Centre.

In the peculiar facts and circumstances of the case, Mr. Manish Soni, Advocate submits that the he be permitted to withdraw his Power of Attorney as he does not wish to give any NOC as the same may have adverse effect on his defence in the complaint before the Bar Council. 6.

Considering the above, the Power of Attorney of Mr. Manish Soni, Advocate is permitted to be withdrawn and the Power of Attorney of Mr. Nitish Banka, Advocate is taken on record. 7.

In light of the above, learned counsel for the petitioners does not press the present petition and prays for withdrawal of the same with liberty to file afresh seeking quashing of FIR on the basis of compromise. 8.

Accordingly, the present petition stands dismissed as withdrawn, with the aforesaid liberty.

It is made clear that the Court has not expressed any opinion on the merits of this case and the liberty granted, if any, is only on the request of the counsel for the petitioner and is not a direction. 10.
