66 $ $787 This Court had summoned respondent No.5 i.e. Junior Engineer, Ward No.22, Municipal Corporation, Yamuna Nagar, Haryana in Court.
Mr. Arvind Kumar, J.E., Municipal Corporation, Yamuna Nagar is present in person in Court today. He has submitted before this Court that due to the paucity of necessary grant, the work could not be completed. Though this Court is not prima facie convinced with the excuses given by respondent No.5, however he submits that the estimate for completion of this Gali has already been sent to the competent authority for further sanction and the tender would be floated, thereafter, incomplete work of construction of this Gali would be completed. He has prayed that time of two months for completing the necessary work be granted.
In view of the submissions made before this Court by respondent No.5, the present petition is disposed of with a direction to respondent No.5 i.e. Junior Engineer, Ward No.22, Municipal Corporation, Yamuna Nagar, Haryana to complete the necessary work as submitted before this Court within a period of two months from today. However, the petitioner would be at liberty to pursue his remedies in accordance with law in case any further cause of action accrues to him. 4 * 5 %
