Present petition has been filed under Article 226/227 of the Constitution of India claiming that the statutory appeal filed by the petitioner is pending with the appellate authority since 28 th December, 2022 and the authorities are bent upon effecting recovery.
Learned counsel for the petitioner at the outset prays for deciding the appeal filed by the petitioner dated 28.12.2022 (Annexure P-3) expeditiously by passing a speaking order within a time bound frame. Notice of motion.
On the asking of the Court Mr. Charanpreet Singh, AAG, Punjab, who is present in Court accepts notice on behalf of the respondents. CWP No. 1004 of 2023 I have heard learned counsel for the parties and have gone through the record of the case.
Keeping in view the innocuous prayer made in the present petition, the appellate authority is directed to consider and decide the appeal dated 28.12.2022 (Annexure P-3), in accordance with law, by passing a speaking order as expeditiously as possible preferably within a period of six months from the date of receipt of certified copy of this order.
Till the appeal is finally decided, no further recovery shall be effected from the petitioner.
The petition stands disposed off.
