G.S.SANDHAWALIA, J. (Oral) The application for additional evidence has been dismissed on account of not being supported by any affidavit. Even in the application filed by the counsel for the tenant, it had been averred that some development had taken place in the office of the Estate Officer and orders have been issued for reconstruction of file which could not be produced at an earlier point of time. The Rent Controller had noticed that neither any communication from the Estate Officer has been placed on record to show that there is any substance in the averment made and in the absence of affidavit, the application is not maintainable.

The reasoning as such does not suffer from any infirmity which would warrant interference by this Court keeping in view the provisions of Section 26 read with Order VI Rule 15(4) and as has been held in Salem Advocates Bar Association vs. Union of India, 2003 (6) SCC 344.
