AMIT RAWAL J. (Oral) The present revision petition is directed against the order dated 26.03.2018 (Annexure P-1) rendered by the District Judge, whereby, transfer application of rent petition filed by respondent-landlord from concerned Court to another Court, has been dismissed. Petitioner, who appears in person has expressed certain observations which could not be comprehended in positive manner gave apprehension in the mind of the petitioner for moving the application. In fact, the documents placed on record by way of additional evidence are required to be adjudicated before the decision of the case but the request was not adhered to, though the application for additional evidence is still pending.

I have heard the petitioner and appraised the paper book and of the view that reasons expressed by the District Judge in declining the Savita 2018.04.26 14:21 I attest to the accuracy and integrity of this document High Court Chandigarh

CR No.2638 of 2018 {2} application are perfectly legal and justified, for, an application for additional evidence is to be decided alongwith main case and not in the manner and mode as indicated above, much less at the whims and fancies and desire of the party, i.e., applicant. It is conceded position on record that application for additional evidence is still pending adjudication. The petitioner is at liberty to raise arguments through counsel at an appropriate stage before the Court below but not at this stage. No ground is made out for interference in the impugned order. Accordingly, the revision petition stands dismissed.
