This petition has been filed challenging the dismissal of the ejectment petition filed by the petitioner/landlady, by the learned Rent Controller, Ludhiana, vide order dated 31.05.2007 as well as judgment dated 22.04.2008 passed by learned Appellate Authority, whereby order dated 31.05.2007 has been upheld.

Learned counsel for the petitioner submits that the petitioner sought eviction of the tenant, as her husband wished to shift to the ground floor of the premises which is in possession of the tenant. However, her husband has since passed away, therefore, the ground for eviction no longer survives. Thus, she seeks to withdraw the present petition. Affidavit dated 14.10.2018 executed by the petitioner in this respect, filed in Court today, is taken on record subject to just exceptions. Petition is accordingly dismissed as withdrawn.
