(Presence marked through video conferencing). ARUN MONGA, J. (ORAL) Petitioner herein, interalia, seeks issuance of a writ in the nature of mandamus directing the respondents to revise Advertisement No.01/2022 issued by respondent No.4.

Learned counsel for the petitioner submits that work experience of the petitioner has been ignored while candidates having similar experience have been given weightage marks. He further submits that petitioner is working on the post of RBSK, Coordinator at the office of Civil Surgeon, Fatehabad since 2012 and his work and conduct has been found satisfactory.

On a Court query, learned State counsel submits that no preference has been given across board to any candidate for the work experience in the past. If that be so, I do not find any ground to interfere since there is no discrimination qua particular set of candidates who have served in National Health Mission and yet not awarded marks for the SHALINI BHATIA 2022.02.18 16:11 I attest to the accuracy and authenticity of this document.

It is prerogative of the employer to set out the requirements which are warranted for the posts sought to be filled in as long as conditions of the advertisement are not violated and are not discriminatory, the petitioner cannot plead violation of any fundamental right.
