AMIT RAWAL J. (Oral) Learned counsel for the petitioner-plaintiff submits that when the petitioner-plaintiff was leading evidence, an application calling upon the defendant-respondent to give specimen signatures was moved and order in this respect was also passed. Defendant did not give the specimen signatures. In cross examination, he was volunteer to give specimen signatures and in this regard, an application was also filed.

I have heard learned counsel for the petitioner-plaintiff and appraised the paper book.

Once such situation arose, in my view, the petitionerplaintiff is at liberty to take all the pleas, as per the provisions of Section 114(g) of the Indian Evidence Act but not in the manner and mode which has been adopted.
