2023:PHHC:130760
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH Sr. No.123-1 CR-2675-2018 Date of Decision: 09.10.2023 BALJIT SINGH ATTRI ....Petitioner
Versus
APNEET KAUR AND OTHERS .....Respondents
CORAM:
HON'BLE MRS JUSTICE ARCHANA PURI Present:- Mr. Vikas Singh, Advocate for the petitioner.
None for contesting respondent No.1.
***** ARCHANA PURI, J. (Oral) At this stage, learned counsel for the petitioner submits that the suit for declaration filed at the instance of Apneet Kaur, has since been dismissed on account of non-appearance, vide order dated 11.04.2019, copy whereof has been filed in the Court today, which is taken on record and therefore, he submits that since the order dated 16.04.2018 also related to the application for interim injunction, hence the appeal filed qua interim injunction also goes.
Perusal of the paperbook reveals about the petitioner having challenged the order dated 16.04.2018 (Annexure P-7), passed by the Court below, whereby the trial Court record was requisitioned, before hearing the arguments on interim injunction application.
Since, the main case has since been dismissed in default vide order dated 11.04.2019, copy whereof is taken on record today itself, the instant revision petition has become infructuous and the same is hereby dismissed, as such.
