Civil Revision No. 3132 of 2015 -1- In the High Court of Punjab and Haryana at Chandigarh Civil Revision No. 3132 of 2015 Date of Decision: 08.5.2015.

Balbir Singh .......Petitioner

Versus

Gurnek Singh ......Respondent CORAM: HON'BLE MRS. JUSTICE SABINA

Present:

Mr. S.K.Bawa, Advocate for the petitioner.

**** SABINA, J.

Petitioner has filed this petition under Article 227 of the Constitution of India challenging the order dated 5.1.2015. I have heard the learned counsel for the petitioner and have gone through the record available on the file carefully. Impugned order dated 5.1.2015 reads as under:- "No PW is present. Adjournment is requested. A careful perusal of the case file transpires that in the present case issues have been framed between the parties on 07.09.2013 and, thereafter, plaintiff availed 08/09 effective opportunities to conclude their evidence including one last opportunity, however, failed to do so till today. No cogent reason has been shown by learned counsel for plaintiff to further adjourn the case for evidence of plaintiff. So evidence of the plaintiff is closed by order. Now to come up on 19.02.2015 for entire evidence of the defendant. PF/DM and list of witnesses be filed within GURPREET SINGH 2015.05.11 15:47 I attest to the accuracy and authenticity of this document Chandigarh

Civil Revision No. 3132 of 2015 -2seven days."

During the course of arguments, it has transpired that after the passing of the impugned order, defendant has also closed his evidence and now the case is listed before the Trial Court for arguments.

Keeping in view the facts and circumstances of the present case, no ground for interference is made out. Dismissed.
