Present petition has been filed by the petitioner namely Sunil Kumar, aged about 34 years, seeking grant of anticipatory bail in case bearing FIR No.188, dated 16.12.2024, under Section(s) 190, 191(3), 121(1), 132, 221, 351(3), 304(2) and 324(4) of the BNS, 2023, (subsequently, Section 121(2) was added) registered at Police Station Sadar Kanina. 2.
After arguing for some time, counsel for the petitioner seeks withdrawal of the present petition, by submitting that the petitioner is ready to surrender before the Investigating Officer or before the Court of Area Magistrate, within a period of one week from today. However, his regular bail application, be directed to be decided within some time bound manner. 3.
Taking into consideration the statement made by counsel for the petitioner, present petition is dismissed as withdrawn. 4.
However, it is clarified that in case, petitioner surrenders before the Investigating Officer or the Court of Area Magistrate, within a period of one week from today, the regular bail application, if any, filed by him, would be decided, within three days thereafter.
