There is no justification for the petitioner to arrive to this Court against the order closing his evidence. It will be open to the petitioner to approach the trial Court itself for reopening the case by setting out the reason as to why he could not be present and why several opportunities which had been availed to, could not be fruitfully put to use. If such an application is filed, the court below will consider the same and pass appropriate orders in the light of the decision passed by this Court in Santosh Kumar Berry Vs. Nirmala Devi and others 2013
