The hearing of the case is preponed for today itself. C.R. No.3138 of 2016 1.

The counsel sought for stay of proceeding in execution on a subsisting decree which has not been set aside so far. The person who causes an objection is person who is purchaser from judgment debtor and the issue of bona fides is irrelevant in such a situation. Any right to stay the proceeding in the decree can be availed only in appeal against the decree which is challenged and cannot be brought at the stage of execution.

The prayer for staying the execution is declined and the revision petition is dismissed.
