The short question, which has been raised by counsel for the petitioner is that the direction passed by the trial court to consider the claim of the petitioner by passing a speaking order, has been violated. I have gone through the order passed by the executing court. The direction to pass a speaking order has been complied with by the concerned authorities by offering a job of Constable to the petitioner on compassionate grounds. He having not opted for the same, cannot turn around to say that his claim has not been properly considered. Counsel for the petitioner submits that the petitioner having achieved higher qualification was entitled to a better consideration. After hearing counsel for the petitioner, I am of the considered opinion that till date order of the trial court to consider the claim of the petitioner has not been disobeyed. No ground is made out to interfere in the impugned order.

Dismissed with liberty to the petitioner to avail any other remedy under law, available to him.
