It is noticed that present is a revision petition preferred by the petitioner-tenant challenging order dated 02.12.2003 passed by the learned Rent Controller, Ludhiana whereby his application under Section 18A of the East Punjab Urban Rent Restriction Act, 1949 seeking leave to contest the rent petition filed by the respondents/landlords, has been dismissed. The counsel, who filed this petition, has been elevated to the Bench of this Court. Notice was accordingly issued to the petitioner.

CR No.415 of 2004(O&M) [2] As per office report, notice issued to the petitioner has been received back with the report that the address is incomplete. Learned counsel for the respondents, on the last date of hearing, submitted that he was also unable to contact the respondents/landlords, despite best efforts and is unable to inform about the present status regarding possession of the demised property. The petitioner could not be served for want of correct and complete address.

In this view of the matter, this Court has no other option but to dismiss this petition in default.

Ordered accordingly.

Liberty is however afforded to the petitioner to move an appropriate application, in case he is still in possession of the demised premises. It is further directed that in case of any execution proceedings initiated by the respondents pursuant to passing of this order, learned Executing Court to send intimation thereof with reference to this petition, which shall be put up before the Court for consideration.

Copy of this order be conveyed to the concerned Executing Court as well as to the petitioner at the available address. ( LISA GILL ) October 16 , 2019.
