This is an application under Order 9 Rule 4 CPC read with Section 151 CPC for restoration of the revision petition which was dismissed for non-prosecution vide order dated 04.10.2024. 2.
For the reasons stated in the application which is supported by an affidavit, the application is allowed and the order dated 04.10.2024 is recalled and the main revision petition is ordered to be restored to its original number.

Learned counsel for the petitioner has submitted that in spite of best efforts, the claimant is not traceable and the claimant is not even pursuing his appeal for enhancement and has thus submitted that the present revision petition be disposed of but liberty be granted to the petitioner to revive the present civil revision in case the claimant revives his appeal i.e., FAO-1910-1994.

In view of the above, the present revision petition is disposed of with the aforesaid liberty.
