The counsel for the petitioner says that he will be satisfied if there is a direction given to the Arbitrator that he will rule on his own jurisdiction under Section 16 on the ground that there was no arbitral agreement with reference to the particular dispute that has arisen in the year 2010-2011. The matter will be decided by the Arbitrator on the basis of any evidence that the petitioner wants to place before him and the same will be considered independently of the decision which is already taken. 2.

The revision petition is disposed of but giving liberty to the petitioner to seek for such consideration and the Arbitrator will consider the petitioner's plea after serving notice to other side and dispose of the application in accordance with law. The petitioner is entitled to resort to any action for summoning any record and same will be considered by the Arbitrator.
