Petitioner has challenged the order dated 12.03.2015 (Annexure P-6), passed by the Additional Civil Judge, (Sr. Divn.), Samana in execution proceedings.

Relevant facts for the purpose of decision of present revision petition that respondents-Lakhbir Singh and another filed suit for possession and permanent injunction against Joginder Singh and LRs of Joginder Singh. The civil suit was decreed, vide judgment and decree dated 06.06.2006 and appeal filed by Joginder Singh was dismissed. Thereafter, the appeal was filed before this Court and at that time LRs of NARESH KUMAR 2011.06.28 16:43 I attest to the accuracy and integrity of this document Chandigarh

Civil Revision No. 3179 of 2015 -2Joginder Singh took the plea that land in dispute i.e. khasra No.682//2/2/2 (2-3) was not in their possession and the appeal was dismissed as withdrawn. The main contention of petitioner that if they dispossess him from above mentioned khasra No., then they would suffer irreparable loss and if after demarcation the said property does not fall under khasra No.682//2/2/2(2-3), then they will vacate the premises. 3.

This contention of petitioner has already been considered by executing Court that LRs of Joginder Singh are not in possession over any portion of the land. As such, they are not going to suffer any prejudice. There are no grounds, to interfere in the said order. Resultantly, the present revision petition being devoid of merit stands dismissed.
