It is a surprising relief which the plaintiff sought that the issue regarding readiness and willingness must be eschewed. This is the only issue relevant even without written statement, for it is statutorily mandated that the Court shall record a finding with regard to readiness and willingness as per Section 16(1)(c) of the Specific Relief Act. It is not an empty formality but it is a necessary aspect of the pleading. 2.

The petition was vexatious and correctly dismissed. The revision petition is also dismissed.
