CHANDIGARH C.R. No.3192 of 2016 Date of Decision.09.05.2016 Sukhmander Singh .......Petitioner Vs.

Boban Singh ........Respondent

Present:

Mr. Deepak Kaushal, Advocate for the petitioner.

CORAM:HON'BLE MR. JUSTICE K. KANNAN 1.

Whether Reporters of local papers may be allowed to see the judgment ?

2.

To be referred to the Reporters or not ?

3.

Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.

The petitioner who is a decree holder is aggrieved that the papers have been consigned to records on the ground that the judgment debtor does not have the means. He has not been given opportunity to prove the means and he seeks such an opportunity. So long as the decree holder is not fettered by an issue of limitation, he can file any number of execution petitions and in such execution petition if he can prove his means, the order already passed will not come in the way. 2.

With this observation, the revision petition is disposed of. (K. KANNAN) JUDGE May 09, 2016 Pankaj* PANKAJ KUMAR 2016.05.10 12:17 I attest to the accuracy and integrity of this document
