Present revision petition has been filed by the landlord challenging judgment dated 02.04.2016 passed by the learned Appellate Authority, Ambala whereby appeal preferred by the respondent/tenant against judgment dated 27.05.2014 passed by the learned Rent Controller, Ambala ordering eviction of the respondent/tenant, was allowed.
Learned counsel for the respondent submits that this petition has been rendered infructuous as the respondent-tenant is not in possession of any OMKAR SINGH 2019.01.19 13:08 I attest to the accuracy and integrity of this document High Court, Chandigarh
CR No.3195 of 2016(O&M) [2] part of the premises belonging to the petitioner and neither is he running his business in a Khokha on the platform of the property in question. It is further submitted that in case respondent-Shekhar Kumar is using electric energy drawn from any meter/sub-meter of the demised premises, the same shall be disconnected forthwith.
Keeping in view the statement made by learned counsel for the respondent, this petition is disposed of as infructuous. Needless to say, in case it is found that the respondent/tenant is in possession of any part of the premises or is using electric energy therefrom, the petitioner/landlord is at liberty to move appropriate application for revival of this petition.
