Petitioner has filed this petition under Article 227 of the Constitution of India challenging the order dated 13.4.2015 (Annexure P-4).

I have heard the learned counsel for the petitioner and have gone through the record available on the file carefully. In the present case, Chand Singh (since deceased) had filed suit for declaration challenging the sale deeds dated 17.7.2009 and 12.12.2008. Chand Singh (since deceased) had filed suit challenging the sale deeds executed by him on the ground of fraud and misrepresentation. During the pendency of the suit, defendant moved an application under Order 7 Rule 11 of the Code of Civil Procedure, 1908. Vide the impugned order, plaintiff was directed to affix ad valorem Court fee. The learned Trial Court had rightly directed the plaintiff to affix ad valorem Court fee as plaintiff Chand Singh (since deceased) was the executant of the sale deeds and had challenged the same.
