Petitioner is facing trial in the Court of learned Special Judge, Amritsar in NDPS case arising out of FIR No.120 dated 25.11.2018 registered at Police Station Tarsikka, District Amritsar Rural under Sections 21 and 22 of the NDPS Act. He was allowed regular bail on 16.05.2019. He was initially attending the proceedings but absented from trial on 11.02.2022. Initially, notice to him was issued and then bailable warrants. . His bail was ultimately cancelled on 19.09.2022 and warrants of arrest were directed to be issued to the petitioner.

Petitioner submits that he could not appear due to death of his father on 10.10.2020. Thereafter, he had fallen ill and gone in depression. Death of the father had taken place on 10.10.2020 whereas bail of the petitioner has been cancelled on 19.09.2022. Anyhow, without commenting anything on the merits of the case, petitioner is directed to surrender before the trial Court on or before 17.03.2023, date already fixed there and move an appropriate application for bail. On moving of such application, learned trial Court shall consider the same and till the application is decided, the petitioner shall not be taken

CRM-M-2912 of 2023 -2into custody. The trial Court will also be at liberty to initiate proceedings under Section 446 Cr.P.C and subject to disposal of those proceedings, bail application shall be considered.

If in the meantime, petitioner is sought to be arrested pursuant to the warrants of arrest issued against him, he shall be admitted to bail to the satisfaction of the Arresting Officer.
