(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No.0013 dated 31.01.2019, registered at Police Station Ajitwal, Distt Moga, who has been booked for having committed the offence punishable under Section 394/452/336/148/149/34 IPC and Section 25/27 of Arms Act, 1959. Learned counsel for the petitioner submits that the F.I.R in the case was registered against unknown person and the petitioner was not named in the above F.I.R.

Learned counsel submits that the co-accused has already been granted bail by this Court vide order dated 13.01.2020 (P-2) which shows that the complainant has identified three accused i.e Vicky, Sukhjinder Singh @ Kaka and the present petitioner. However, the petitioner was stated to have been identified by the husband of the complainant. Learned counsel for the petitioner while referring to F.I.R GAURAV ARORA 2020.05.19 16:13 I attest to the accuracy and integrity of this document Chandigarh

Crl. Misc. No. M-2730 of 2020 -2states that the husband of the complainant was not present at the spot and had gone to Moga and thus, the petitioner had been falsely implicated. Learned State counsel on instructions has informed the Court that the challan has already been presented on 23.05.2019 and charges were framed on 26.07.2019. The supplementary challan against one Raj Kumar was present on 17.03.2020.

Heard.

Petitioner is in custody since 12.03.2019 Keeping in view the fact that the trial is likely to take some time to conclude, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Moga.
