The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to respondent No. 2 to issue him passport.

The petitioner vide application dated 08.11.2019 applied for passport. An FIR No. 40 dated 20.03.2018, under Sections 306, 201 of IPC came to be registered against the petitioner at Police Station Bhikhi, District Mansa. The police after completing investigation filed challan against others, however, petitioner was declared innocent. The trial court, on application under Section 319 Cr.P.C., summoned the petitioner as an additional accused. CWP No.1492 of 2024 -2- 2024:PHHC:008338 this Court seeking setting aside of aforesaid summoning order. This Court vide order dated19.05.2022 directed the trial court to adjourn the case beyond the date fixed before this Court. The said order has been further extended.

Counsel for the petitioner submits that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391 6.
Faced with this, counsel for Union of India submits that application of the petitioner would be disposed of within six weeks from today in the light of afore-state judgment of this Court. 7.
In the wake of statement of counsel for Union of India, the petition stands disposed of.
