Apprehending his arrest in FIR No.133 dated 28.11.2023, registered for offences punishable under Sections 22/29/61/85 of the NDPS Act, at Police Station Sadar Moga, District Moga, the petitioner has preferred this petition under Section 438 Cr.P.C. seeking pre-arrest bail.

Ld. Counsel for the petitioner inter alia contends that the petitioner has been nominated on the basis of the disclosure made by co-accused Paramjit Singh @ Pappa and apart from that there is no allegation against the petitioner. He further submits that the petitioner has clean antecedents. Reliance is being placed upon Tofan Singh vs. State of Tamil Nadu, (2021) 4 SCC 1. Issue notice of motion, returnable for 22.04.2024. Mr. Tarun Aggarwal, Sr. DAG, Punjab appears and accepts notice on behalf of the respondent/State.

In the meantime, in the event of arrest, the petitioner shall be released on interim bail subject to his furnishing personal and surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. As and when called, the petitioner shall join the investigation. He shall abide by the conditions enumerated under Section 438(2) of the Cr.P.C.
