Prayer in the instant petition filed under Section 438 Cr.PC is for grant of anticipatory bail in case FIR No.110 dated 04.11.2019 registered under Sections 306/201 IPC at Police Station Banur, District SAS Nagar (Mohali).

Learned counsel for the petitioner contends that totally false and concocted allegations have been levelled against the petitioner by the complainant just to harass and humiliate him and his family members. A perusal of the FIR however, reveals that the petitioner, who is the husband of the deceased, was subjected to both mental and physical violence by the petitioner and his family. There are allegations that even before the complainant and his family reached on getting the information of the death of the deceased Harpreet Kaur i.e. wife of the petitioner, the accused including the petitioner had already set the pyre of the deceased on fire. CRM-M-2321-2020 -2managed to retrieve the partially burnt body of the deceased and inform the police.

Keeping in view the facts and circumstances of the case and submissions made by learned counsel for the petitioner, no ground for grant of anticipatory bail is made out. Accordingly, the present petition is dismissed. However, it is clarified that nothing observed herein above would be construed as an expression on the merits of the case.
