Prayer in the present petition is for transfer of the petition filed by the respondent-husband under Section 13 of the Hindu Marriage Act, 1955, bearing case No.775/2022 titled as Jagjit Singh Rai vs. Manpreet Kaur, pending before learned Principal Judge, Family Court, Hoshiarpur to a Court of competent jurisdiction at Jalandhar. 2.

Upon notice, respondent in person along with counsel has put in appearance. Learned counsel for the respondent on instructions states that in view of the settled proposition of law that in such like cases convenience of the wife is to be seen, he has no objection in case the present petition is allowed and the above captioned matter be transferred to the Court of competent jurisdiction at Jalandhar. 3.

Heard learned counsel for the parties and with their assistance perused the record.

In the light of conceded position noticed above, the present petition is allowed, by issuing the following directions:- a) The petition filed by respondent-husband under Section 13 of the Act, titled as Jagat Singh Rai vs. Manpreet Kaur, pending in the Court of Principle Judge, Family Court, Hoshiarpur is transferred to a Court of competent jurisdiction at District Jalandhar. b) The learned District Judge, Hoshiarpur is directed to transfer complete record pertaining to the aforesaid case to learned District Judge, Jalandhar.

c) The parties through their counsel are directed to appear before the learned District Judge, Jalandhar, on 15.05.2024.

d) The learned District Judge, Jalandhar will assign the said petition to the Court of competent jurisdiction. e) The concerned Court at Jalandhar, shall diligently strive to amicably resolve the marital discord between the parties by referring the matter to the Mediation and Conciliation Centre.

Accordingly, the present petition is disposed of in the aforesaid terms. Copy of this order be sent to both the Courts for information and necessary compliance.
