There can be no prejudice to the petitioner for impleadment being allowed in a case where a third party claims himself to be an employer and the respondents already on record have also claimed that it is third party who was the employer. The petitioner, who is the workman, has contended that he is the employee of only respondent No.1 and 2 and the third respondent who is now brought on record is wholly an unnecessary party.

In the line of defence taken by the persons who are said to be employers that they are not petitioner's employers but it is only the third respondent who was brought on record was the employer, it will be appropriate and just that the petitioner's right is assessed in the presence of the person who is claimed to be the employer. No prejudice can be caused to him. The order impleading the third party is PANKAJ KUMAR 2016.05.12 14:38 I attest to the accuracy and integrity of this document
