The petitioner had instituted the instant writ petition challenging the action of the respondents in re-tendering the work of Design, Manufacture, Supply, Erection, Testing and Commissioning including Warranty, Operation & Maintenance for ten years for total aggregate capacity of 3000 kWp Grid-Connected Floating SPV power plant with high power evacuation on HT side at tank No.5 & 6, Water Works, Sector 39, Chandigarh.

Initially, vide e-tender notice dated 14.02.2023 (Annexure P-3), bids had been invited for the said work and the petitioner was confirmed as

 L-1 after completion of the process of opening of technical as also financial bids.

In pursuance of the acceptance given by the petitioner and in pursuance of the L-1 announcement, the petitioner-firm is stated to have invested a huge amount on design/engineering/hiring of manpower. However, work orders etc. were not issued.

One M/s Hartek Solar Private Limited had quoted different rates in the BOQ summary and cost break up as a result of which, ultimately, a decision was taken to re-tender the work. This led to the filing of the instant writ petition.
