Petitioner has filed this petition under Article 227 of the Constitution of India challenging the order dated 6.4.2015 (Annexure P-3) whereby custody of the minor child namely Pawanpreet Singh was handed over to the respondent. I have heard the learned counsel for the petitioner and have gone through the record available on the file carefully. Respondent has filed petition under Section 25 of the Guardians and Wards Act, 1890 for custody of minor child Pawanpreet Singh. During the pendency of the petition, respondent moved an application for custody of minor child Pawanpreet Singh. Petitioner has been convicted and sentenced qua commission of offence punishable under Section 304-B of the Indian Penal Code, 1860 in FIR No. 93 dated 24.8.2012. Presently petitioner is lodged in Central Jail, Gurdaspur. In these circumstances, the learned GURPREET SINGH 2015.05.20 15:35 I attest to the accuracy and authenticity of this document Chandigarh
Civil Revision No. 3373 of 2015 -2Trial Court rightly held that the custody of minor child Pawanpreet Singh be handed over to the respondent as presently petitioner is confined in jail and respondent, being the natural guardian of the child, would be in a better position to take care of the child. Moreover, the arrangement made vide the impugned order, is merely an interim arrangement.
No ground for interference is made out.
