(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No.0389 dated 14.04.2018, registered at Police Station Karnal City, District Karnal, who has been booked for having committed the offence punishable under Section 380/457 IPC.

Learned counsel submits that the co-accused Shokin @ Sunda has already been granted bail by the Addl. Sessions Judge, Karnal vide order dated 15.11.2018 (P-2). The bail application of the petitioner has been rejected on 07.01.2020 by learned ASJ, Karnal on the ground that some cases are pending against the petitioner. However, learned counsel has referred to para No. 7 of the petition wherein it has been mentioned that the petitioner is on bail in all the above cases. Learned State counsel has not disputed the fact that the petitioner is on bail in the above cases.

Petitioner is in custody since 29.08.2018 Keeping in view the fact that the trial is likely to take some time to conclude and the fact that the co-accused had already been granted bail, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Karnal.
